This article provides a substantial analysis of various issues concerning the recognition and enforcement of foreign arbitral awards in Poland. The author explains the nuances regarding Poland and the UN Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York, 10 June 1958) and the European Convention on International Commercial Arbitration (Geneva, 21 April 1961); national sources of Polish law on recognition and enforcement of foreign arbitral awards. It also looks at common rules for both domestic Polish and foreign awards, differences in the enforcement of domestic Polish and foreign arbitral awards, the formal requirements for presenting arbitration clauses, the procedure for enforcement, including extraordinary appeals, the impact of set-aside proceedings for enforcement, conditions denying enforcement, and the adjournment of enforcement proceedings. The author also provides Polish case law on the enforcement of foreign arbitral awards in Poland. He still believes that Poland is an arbitration friendly country where arbitration and post-arbitral court proceedings may give members of the international arbitration community a great deal of professional satisfaction.
